AGNEO Platform Terms and Conditions 

Welcome to AGNEO. These Terms and Conditions govern your use of AGNEO’s online platform (“the Platform”) for the sale and purchase of handmade jewelry. By using the Platform, you agree to be bound by these Terms and Conditions. 

1. Use of the Platform 

1.1 The Platform is provided for the purpose of facilitating the sale and purchase of handmade jewelry between buyers and sellers. 

1.2 AGNEO is not a party to any agreement entered into between buyers and sellers, nor is AGNEO an agent of any buyer or seller. AGNEO does not take title to any goods sold through the Platform. 

1.3 AGNEO makes no representations or warranties as to the quality, safety, or legality of any goods sold through the Platform. 

1.4 By using the Platform, you agree to comply with all applicable laws and regulations, as well as these Terms and Conditions. 

1. User Accounts 

2.1 To use the Platform, you must create a user account. You agree to provide accurate and complete information when creating your account. 

2.2 You are responsible for maintaining the security of your account, including your login credentials. 

2.3 You agree to notify AGNEO immediately if you suspect any unauthorized access to your account. 

1. Seller Obligations 

3.1 By listing goods for sale on the Platform, sellers represent and warrant that they are the rightful owners of the goods, and that the goods do not infringe any third-party rights. 

3.2 Sellers agree to provide accurate and complete information regarding the goods listed for sale. 

3.3 Sellers are responsible for fulfilling orders in a timely and professional manner. 

1. Buyer Obligations 

4.1 By purchasing goods through the Platform, buyers agree to pay the purchase price and any applicable taxes and fees. 

4.2 Buyers agree to provide accurate and complete information regarding the shipping address and payment information. 

4.3 Buyers are responsible for reviewing the seller’s product information and making informed decisions about their purchases. 

1. Intellectual Property 

5.1 AGNEO owns all right, title, and interest in and to the Platform, including all intellectual property rights. 

5.2 Sellers retain ownership of all intellectual property rights in their goods. 

5.3 Buyers may not use any intellectual property belonging to AGNEO or any seller without express written permission. 

1. Dispute Resolution 

6.1 AGNEO is not responsible for resolving disputes between buyers and sellers. 

6.2 Buyers and sellers agree to make good faith efforts to resolve any disputes arising from the sale or purchase of goods through the Platform. 

6.3 In the event of a dispute, AGNEO may provide mediation services upon the written request of both parties. 

1. Limitation of Liability 

7.1 AGNEO is not liable for any indirect, special, or consequential damages arising from the use of the Platform, including but not limited to lost profits, loss of data, or interruption of business. 

7.2 AGNEO’s liability to any user is limited to the amount of fees paid by that user to AGNEO in the preceding twelve (12) months. 

1. Termination 

8.1 AGNEO may terminate or suspend any user account at any time for any reason. 

8.2 In the event of termination, AGNEO will provide notice to the affected user. 

8.3 Upon termination, all rights and obligations of the parties under these Terms and Conditions will immediately cease. 

1. Modifications 

9.1 AGNEO reserves the right to modify these Terms and Conditions at any time. 

9.2 Any modifications will be effective immediately upon posting. 

 

.3 Your continued use of the AGNEO platform after any modifications indicates your acceptance of the modified Terms and Conditions. 

Governing Law 

10.1 These Terms and Conditions and any dispute arising out of or related to your use of the AGNEO platform shall be governed by and construed in accordance with the laws of [Insert governing law here]. 

10.2 Any legal action or proceeding arising out of or related to these Terms and Conditions or your use of the AGNEO platform shall be brought exclusively in [Insert jurisdiction and venue here] and you agree to submit to the personal jurisdiction and venue of such courts. 

Limitation of Liability 

11.1 AGNEO shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the AGNEO platform, including, but not limited to, damages for loss of profits, loss of data, or other intangible losses. 

11.2 AGNEO's liability to you for any direct damages arising out of or in connection with your use of the AGNEO platform shall be limited to the amount you paid for the service. 

Entire Agreement 

12.1 These Terms and Conditions, together with any policies or guidelines posted on the AGNEO platform, constitute the entire agreement between you and AGNEO with respect to your use of the platform and supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and AGNEO. 

12.2 If any provision of these Terms and Conditions is held to be invalid or unenforceable, such provision shall be struck out and the remaining provisions shall be enforced to the fullest extent under law.
